By using our website (the "Site"), including filling out our locating forms or communicating with our licensed agents, you agree to comply with and be bound by the following terms and conditions (the "Terms of Service"). Please read them carefully. If you do not agree to these terms, you should not access or use this Site.

2. Free Locating Service & Referral Agreement

Apartment Key is a licensed real estate entity in the State of Texas. Our locator search and referral services are 100% free of charge to renters.

To keep our locating service free, you agree to support us by performing the following actions:

Write "Apartment Key" as your Referral Source / Renter Referral Agency on all guest cards when visiting properties.
Write "Apartment Key" as your Referral Source on the official lease application of the property you choose.
Inform your Apartment Key locator immediately once you sign a lease.

Apartment complexes pay our brokerage a marketing referral commission out of their advertising budget when you list us on your lease. Failure to write us down on the application may result in the property refusing to credit our service.

3. User Information & Form Accuracy

By registering on the Site, using our intake widgets, or initiating a locator request:

You agree to provide true, accurate, and current information regarding your contact details, budget, income, rental history, pet criteria, and move-in timeline.
You represent that you are at least 18 years of age and possess the legal authority to enter into agreements for apartment rentals.

4. Inventory & Pricing Disclaimer

Apartment pricing, availability, look-and-lease specials, and criteria are highly dynamic and set entirely by individual property management teams. While Apartment Key uses real-time MLS feeds and properties database queries to curate lists, we make no warranties or representations as to the absolute accuracy of pricing, concessions, pet weights, or criteria. Final pricing and qualification conditions must be verified directly with the leasing office.

5. Automated Messaging & Consent to Communication

By providing your phone number and email address on the Site, you provide your express consent to receive automated text (SMS/MMS) messages, newsletters, property matching sheets, and updates from Apartment Key or its licensed partners. You may opt-out of text updates at any time by replying "STOP" to any text message, or unsubscribe from emails using the link provided. Standard carrier message and data rates may apply. Consent to communications is not a condition of leasing.

6. Licensing & Brokerage Representation

All real estate locating services are provided under the brokerage license guidelines of the State of Texas (TREC). Apartment locators are licensed real estate sales agents.

7. Limitation of Liability

In no event shall Apartment Key, its directors, employees, or licensed partners be liable for any direct, indirect, incidental, or consequential damages resulting from your use of the Site, property tours, lease agreements, disputes with landlords, or issues related to apartment qualification. The final lease agreement is strictly between the renter and the apartment community.

8. Changes to Terms

We reserve the right to modify these Terms of Service at any time. Your continued use of the Site following updates constitutes your acceptance of the revised terms.
